Please read this agreement carefully. This page sets out the terms under which Net Resources International, a trading division of Progressive Media Publishing Ltd offers you use of its Services (as defined in clause 1 of this agreement). By using any of the Services and or industryappointments.com ("the Website") you agree that you have read and accept these terms and conditions and that they shall apply to your use. If you do not wish to be bound by them please do not register or use this website.

  1. The Services
    1. In operating this website Progressive Media Publishing Ltdmakes available an online recruitment and employment information service. Recruiters may submit job adverts which they have and if these job adverts interest you, you may apply and submit responses to such positions (the "Services").
    2. Please note that in responding to job adverts you are responding to recruiters directly and as such any contracts or arrangements will be formed between you and them, without Progressive Media Publishing Ltd as a party and Progressive Media Publishing Ltd cannot be held liable for your use of or any liability arising out of the same (save as to the extent required by law).
    3. The services available to job seekers are only available upon completion of the registration section of the website including confirmation that the terms and conditions have been accepted.
  2. Use of the Website and the Services
    1. The information on this Site has been included in good faith for general informational purposes only. The Website may contain information submitted by a third party including adverts. The information should not be relied upon for any specific purpose and no representation or warranty is given as to its accuracy or completeness. Progressive Media Publishing Ltd will not limit access to content unless it is notified that it is illegal. You acknowledge that Progressive Media Publishing Ltd is not responsible for and does not monitor the content of job postings provided by third parties on the website. However Progressive Media Publishing Ltd will have the right to remove any postings, materials or other items on the website which it believes may be illegal or which it determines are inappropriate.
    2. You may copy electronically and print portions of the website and / or the Services for your personal or non-commercial use only. In particular, you may not use any information from any directory or other listing made available on the Website and / or the Services (including without limitation reproduction for a purpose other than that noted above and any modification, replication or duplication) without the prior written permission of Progressive Media Publishing Ltd is strictly prohibited.
    3. Any opinions (express or implied) are those of the individual authors and not necessarily those of Progressive Media Publishing Ltd or its partner organisations.
    4. Except for any express warranties or undertakings given on the Website, we exclude all warranties (express or implied) in respect of the Website and the content of and your use of the Website.
    5. Progressive Media Publishing Ltd shall not be liable to you for any loss that you suffer (including, without limitation, damages for any consequential loss or loss of business opportunities or projects, or loss of profits) howsoever arising, whether in contract, tort or otherwise from your use or inability to use this Website or Services, or any of its contents, or from any action or omission taken as a result of using this Website provided that nothing in these terms shall exclude or limit our liability for personal injury or death caused by our negligence. Your use of all information and / or data is therefore entirely at your own risk. There is no liability of Progressive Media Publishing Ltd, its directors, employees or other representatives howsoever arising for any loss suffered as a result of using this website and or services.
    6. We may provide links to other websites from time to time. These links are provided for your convenience. We do not endorse or take responsibility for the content of those websites, we are not responsible for the availability of them and will not be liable in any way for any loss or damage which you may suffer by your use or inability to use those websites.
    7. If you decide to access linked websites you do so at your own risk. If you purchase any goods or services from a third party or third party website to which we provide a link your contract for the supply of those goods and services will be with that third party.
    8. You agree not to use the services we provide via the Website to:
      1. Transmit any information or do anything that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
      2. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
      3. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the services
      4. Transmit any information that you do not have a right to transmit or which infringes another's rights;
      5. Transmit any unsolicited or unauthorised promotion (including without limitation "junk mail", "spam", "chain letters" or "pyramid schemes");
      6. Transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
      7. Interfere with or disrupt the services or servers or networks connected to the services, or disobey any requirements, procedures, policies or regulations of networks connected to the services; or collect or store personal data about other users.
    9. By registering to use the Services pursuant in section 1 you automatically and hereby grant to Progressive Media Publishing Ltd a royalty free right to display, copy, reproduce and make available on the website and otherwise deal with as necessary to provide to you the Services any material and information which you may provide to Progressive Media Publishing Ltd through your use of the Services.
    10. Reference to any product or service on the Website does not constitute an offer to sell or supply that product or service and does not mean that the product or service is available in all countries or that the name and description of any product in your country will be the same as that included on the Website.
    11. Progressive Media Publishing Ltd will not be party to any communications whatsoever between you and those responding to any use which you may make of the Services, although Progressive Media Publishing Ltd reserves the right to monitor any such communications which are made by you or third parties by means of the Website and/or the Services.
    12. We have taken every care in the preparation of the Website. However, as certain technical matters may be beyond our control, we cannot guarantee that you will have uninterrupted or error-free access to the Website at all times.
    13. We make no warranty that the contents of the Site or any and that all emails communicated through the site are free from infection by viruses or anything else which has contaminating or destructive properties and shall have no liability in respect thereof.
    14. We reserve the right at any time, without liability for doing so, to modify or discontinue, temporarily or permanently, any of the content, functions or services we offer on the Website (or any part of them) with or without notice. This includes removing information transmitted by you to us.
    15. You agree that the information you provide us with when you use the Website will be true and complete and that you will keep it true and complete.
  1. Intellectual Property

Save as to the extent permitted in this agreement, Progressive Media Publishing Ltd does not grant any license or any other authorisation to use any of its trade marks, product names, company names or logos or any of its copyright works or any other intellectual property rights by placing them on or making them available by means of the Website or Services.

  3. Registration
  4. You agree to notify us of any changes which are relevant to the application process as part of this Website. You further agree to keep the password associated with your registration private and only use if for you to log-in to our Services.

  5. CV
  6. If the job seeker has their details and CV stored on industryappointments.com the provisions set out below shall apply:

    1. Progressive Media Publishing Ltd cannot guarantee a minimum number of times a CV will be viewed by or distributed to recruiters listed on industryappointments.com on any given day.
    2. The CV database service will be available to paying clients at all times and will allow paying clients access to all CVs submitted to the CV database.
    3. Progressive Media Publishing Ltd may at its own discretion and without notice report improper or illegal use of CVs or the Services by the candidate to customers.
    4. Progressive Media Publishing Ltd has the right at its sole discretion to decline to distribute, grant access to, suspend or remove any candidate information or CV which has been registered to industryappointments.com.
    5. Progressive Media Publishing Ltd may refuse, withdraw, or require to be amended, any candidate or registrants information which is illegal, immoral, obscene or offensive or so as to comply with the legal or moral obligations placed upon Progressive Media Publishing Ltd or to avoid infringing a third party’s rights or any statutory or regulatory requirements or is designed to or is likely to cause disruption to any computer system or network.

The candidate undertakes that:

      1. The details and CV they store and save on industryappointments.com are a true and accurate reflection of their education, employment, training history and that their person details are correct;
      2. That if Progressive Media Publishing Ltd finds a candidate’s information for the purpose of gaining employment to be incorrect or false in any way, that Progressive Media Publishing Ltd reserves the right to remove their details and / or suspend the use of the Services on the Website for the candidate;
      3. In respect of any information or CV submitted by the candidate which contains the name or pictorial representation of any other living person that the candidate has obtained the authority of such living person to make use of their name and / or pictorial representation.
  1. Application and Application Forms

If the job seeker makes an application or is required to complete an application form as part of an application, the provisions set out below shall apply:

    1. The candidate undertakes that:
      1. They have fully read and understood the requirements of a vacancy job posting on the Website to which they have made an application.
      2. They have the appropriate skills and qualifications required by the recruiter and the necessary qualifications required by law.
      3. They satisfy or will attend to the necessary immigration requirements of the country in which the position will be situated.
      4. The details which they supply are a true and accurate reflection of their education, employment, training history and that their personal details are correct.
      5. That if any of the information included within the application process is found to be false or inaccurate in any way, Progressive Media Publishing Ltd reserves the right to remove those details and / or suspend the use of the Services on the Website for the job seeker.
      6. In respect of any information submitted during the application by the job seeker which contains the name or pictorial representation of any other living person that the candidate has obtained the authority of such living person to make use of their name and / or pictorial representation.
    2. Progressive Media Publishing Ltd has the right at its sole discretion to decline to distribute or forward, or to suspend or remove any application accepted by it.
    3. Progressive Media Publishing Ltd may refuse, withdraw, or require to be amended, any application which is illegal, immoral, obscene or offensive or so as to comply with the legal or moral obligations placed upon Progressive Media Publishing Ltd or to avoid infringing a third party’s rights or any statutory or regulatory requirements or is designed to or is likely to cause disruption to any computer system or network.
    4. When a job seeker makes an application through industryappointments.com, Progressive Media Publishing Ltd will pass the job seeker’s details to the recruiter who placed the job advert for the purpose of that one application only.
    5. The candidate accepts that Progressive Media Publishing Ltd cannot be held responsible for the content of job advertisements or any other advertisements on the Website in accordance with the Disclaimer found on this Website and that no obligations are imposed on Progressive Media Publishing Ltd in this regard.
  1. Data Protection
  2. Your data will be processed and collected in accordance with the privacy agreement outlined on this website.

    The information gathered on this Website and in you using the Services may be used by Progressive Media Publishing Ltd and companies in the same group internally, for purposes relating to your use of the Websites and for other marketing purposes. By marketing activities we mean communication directly to particular individuals (by email, post, facsimile or telephone).

    Other than as set out elsewhere in the Privacy Policy your information shall not be disclosed or used by us.

    You hereby agree to the terms in the Privacy Policy by your agreement to the terms and conditions of this agreement.

  3. Force Majeur
  4. Neither party shall be liable to the other, for any loss or damage which may be suffered by the other party due to any cause beyond the first party’s reasonable control including without limitation any power failure.

  5. Notices
  6. Any notices shall be given in writing and shall be given by sending the same by email and first class post. Any notice sent by first class post shall be deemed to have been delivered two days after sending. Any notice given by email shall be deemed to have been delivered on the next working day following transaction.

  7. Assignment
    1. This agreement shall be personal to you and you may not assign, transfer, sublet, lease or delegate all or any of your rights and obligations, without Progressive Media Publishing Ltd’s prior written consent.
    2. Progressive Media Publishing Ltd reserves the right to assign or transfer all or any of its rights and obligations under this Agreement to any companies in the same group as Progressive Media Publishing Ltd or any other third party. In the event of assignment or transfer you will be given notice as outlined in section 7 of this agreement or by a notice on this Website.
    3. No Waiver
    4. Failure or neglect by either party to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any other occasion.

    5. Severability
    6. If any provision of this Agreement or part thereof is determined to be invalid, unlawful or unenforceable, such provision, or part thereof, shall be severed from the remaining terms, conditions and provisions which shall continue to be valid and enforceable to the fullest extent as permitted by law.

    7. Changes to this agreement
    8. Changes may occur to this agreement and Progressive Media Publishing Ltd reserves the right to change this agreement at any time for any reason. Changes will be notified to you by email or posted on the Website. Changes in this manner shall be deemed to be accepted if you continue to use the Website and or the services after a period of two weeks from the date of the email or of posting the changes to the Website.

    9. Law and Jurisdiction
    10. This agreement shall be governed by the laws of England and Wales and you hereby submit to the exclusive jurisdiction of the English courts.

    Recruiter Terms and Conditions

    These Conditions are deemed accepted by the Customer when the Services of industryappointments.com have been accessed by the Customer or ordered and upon signature of the Purchase Order by the Customer.

    Definitions

    Advertisement

    Any recruitment job advert including textual advertisements, featured recruiter banners, logo buttons, corporate profiles, A-Z listings, homepage banners, job of the week, premium job listings, jobs by email sponsorship and / or any page (s) of Customer advertising together with any other form of advertising that will appear on industryappointments.com from time to time.

    Applicant

    Means a job seeker who has applied for a job vacancy or responded to an Advertisement.

    A-Z Listing

    A listing in either the Recruiter or Agency A-Z list describing a company or recruitment agency, containing no more than 50 words.

    Candidate

    Means an individual (who may also be referred to as a job seeker) seeking to obtain employment using the industryappointments.com website or any other website owned and operated by Progressive Media Publishing Ltd.

    Corporate Profile

    A listing in either the Recruiter or Agency A-Z list describing a company or recruitment agency, containing no more than 1000 words.

    Customer

    Means any person, organisation or company which purchases services from Progressive Media Publishing Ltd or any of its subsidiaries. This is not limited to Direct Employers, Recruitment Agencies and Advertising agencies. In the event of an advertising agency, Progressive Media Publishing Ltd will charge the advertising agency and not the Agency’s end client.

    CV Database

    The service which enables the Customer to search Progressive Media Publishing Ltd’s database of candidate CVs, using various search criteria.

    Direct Employer

    A Customer who in relation to the Services is receiving them for the purpose of their own recruitment and not on behalf of any other 3rd party end client.

    End Client

    The person to whom the Customer’s services are provided.

    Job of the Week

    Means an Advertisement on the homepage linking through to a Job Advert which is paid for by a Customer.

    Jobs By Email

    A service which matches and sends vacancies via email to Candidate who have subscribed to this service.

    Job Postings

    Means job adverts submitted to the recruitment website by recruiters.

    Logo Buttons

    Means the button banners in place on the homepage or the sector homepage displaying featured recruiter image, name or logos.

    Premium Job Postings

    Means jobs submitted by Customers which appear differentiated within Candidates’ search results which are found above basic Job Postings.

    Publication Date

    The date at which Progressive Media Publishing Ltd has specified to the Customer that their Advertisement should be made live.

    Purchase Order

    Means the form which the Customer signs in order to obtain the Services.

    Services

    The services which Progressive Media Publishing Ltd has agreed to provide to the Customer and includes Advertisements, CV Database and other services which may be provided to the Customer.

    Vacancy Posting Software

    Means the automated vacancy posted software such as Conkers or Broadbean or their equivalents.

    Websites

    Means all website owned and managed by Progressive Media Publishing Ltd

    1. Services
      1. The Customer agrees to provide to Progressive Media Publishing Ltd, in such a format that Progressive Media Publishing Ltd may request, any information, artwork and logos to enable Progressive Media Publishing Ltd to provide the services.
      2. Progressive Media Publishing Ltd shall not be obliged to provide the Services until the Customer has supplied it with the information set out in section 2.1. Such information shall be supplied to Progressive Media Publishing Ltd or uploaded by the Customer to industryappointments.com within 10 working days of the date of the signed Purchase Order, or such later date as agreed with Progressive Media Publishing Ltd and specified on the Purchase Order as ‘Publication Date’.
      3. The Services will commence on the Publication Date as specified on the Purchase order and will remain on the Website for the length of time as defined by the Duration on your Purchase Order.
      4. Customers can make advertisements live by logging into the Recruiter Area. Progressive Media Publishing Ltd accepts no responsibility for the content published by Customers or errors made by Customers on industryappointments.com in accordance with the Disclaimer outlined on this website. Should the Customer provide information to Progressive Media Publishing Ltd for Progressive Media Publishing Ltd to publish, Advertisements will only be made live on the Site when the Customer has approved the information.
      5. In agreeing to these Terms and Conditions, the Customer accepts that industryappointments.com is an advertising medium and Progressive Media Publishing Ltd cannot guarantee a particular level of response to adverts and that no employee of Progressive Media Publishing Ltd or its subsidiaries has made such guarantees.
      6. Customers may modify their submitted job advert by logging into the recruiter area. Changing your job Advertisement will impact your performance in search engines and as such Progressive Media Publishing Ltd does not recommend this course of action. Progressive Media Publishing Ltd makes no guarantees as to performance of our websites in search engines.
      7. Once a Purchase Order is signed by the Customers, the Purchase Order remains in force for the full duration of the Term and may not be cancelled at any time without the written permission of Progressive Media Publishing Ltd.
      8. The Customer may remove an Advertisement from the Site before the Advertisement has reached its expiry date, but shall not be entitled for a refund of the time not used.
      9. If any part of the Services which are outlined on the Purchase Order are not used within the time period outlined on that Purchase Order, then the client will remain responsible for the full payment of the invoiced amount as if the Services had been properly utilised. Unused Services may not be carried over to any subsequent period.
      10. Progressive Media Publishing Ltd reserves the right to withdraw, reject, amend, cancel or remove any Advertisement or provision of Services for any reason at any time without prior notice. This will not affect your obligation to pay for the Services outlined on your Purchase Order.
      11. An Advertisement or Service which indicates or can reasonably be understood as indicating, an intention to discriminate on grounds of sex, race or age will not be accepted unless it is exempted from the requirements of the Sex Discrimination Act or the Race Relations Act or the Age Discrimination Act (or other internationally relevant laws). A statement must be made at the time the Advertisement is placed or Service used saying which of the exemptions in each relevant Act(s) is considered to apply.
      12. Progressive Media Publishing Ltd will use its reasonable endeavours to provide relevant log-in information or provide its Services on the agreed date. Progressive Media Publishing Ltd does not accept liability for any consequences, howsoever arising due to error in provision of the Services and has the right at its sole discretion to decline to publish or omit suspend or change the position of any Advertisement submitted by Customers or accepted by it.
      13. Links to Client’s own websites shall not be permitted to appear in the Advertisement without Progressive Media Publishing Ltd’s prior permission.
      14. Progressive Media Publishing Ltd may at its discretion and without prior notice report any Advertisement of Service used which in its reasonable opinion is being used for an improper or illegal purpose by a Customer. Progressive Media Publishing Ltd may also disclose information about any Customer to any third party as Progressive Media Publishing Ltd shall deem necessary to protect its interests or the interests of Customers, Recruiters and Candidates and / or other users of the Site.
      15. Progressive Media Publishing Ltd shall at any time be entitled to make changes to the Services, which are necessary to comply with any applicable security or other statutory requirements and shall determine the manner in which the Services are provided.
      16. Progressive Media Publishing Ltd will only supply CVs which it has been received which have been given permission to be viewed by Customers for the purpose of seeking employment for Candidates.
    2. Price and Payment
      1. The Customer shall pay to Progressive Media Publishing Ltd for Services described on the Purchase Order form in full and shall pay all applicable VAT and other taxes imposed on charges for services made under this agreement.
      2. Prices quoted on the Purchase Order are exclusive of VAT.
      3. All invoices are to be paid by the Customer within 14 days of the date of invoice. Should your accounts fall overdue then interest will be charged at the rate of 3% per annum above Lloyds TSB Plc’s base rate from time to time in force. Interest will be calculated daily from the due date to the actual payment date.
      4. Invoices will be issued upon processing your order as outlined on your Purchase Order.
      5. Any errors or omissions on the Purchase Order must be communicated with Progressive Media Publishing Ltd in time to be rectified before payment becomes due.
    3. Liability
      1. Progressive Media Publishing Ltd does not verify or guarantee any Applicant’s details whether forwarded to the Customer via industryappointments.com or otherwise. Progressive Media Publishing Ltd accepts no responsibility as to the suitability of Applicants who respond to Advertisements or Services.
      2. The Customer shall satisfy itself as to the suitability of any Applicant and shall take up any reference provided by the Applicant before engaging any such Applicant.
      3. The Customer shall be responsible for obtaining work, or any other permits, for the arrangements of medical examinations and / or investigations into medical history of any Applicant, and shall satisfy itself of any medical or other requirements of qualifications required by law.
      4. Progressive Media Publishing Ltd does not accept liability for any damages (including without limitation, damages for any consequential loss or loss of business opportunities and/or profits) however arising and whether in contract, tort or otherwise from the use of or inability to use the website or publication, or any of their contents, or from action or omission taken as a result of using the website or publication or any such contents.
      5. Progressive Media Publishing Ltd does not accept liability for any errors or omissions or claims for losses arising from any free of charge services.
      6. Progressive Media Publishing Ltd makes no warranty that this Website (or that any other Website that is linked to this Website) is free from computer viruses, ‘Cookies’, or any other malicious or impairing computer programmes and / or this Website shall operate uninterrupted and error-free.
      7. Progressive Media Publishing Ltd does not accept liability, of any description, howsoever arising, for the loss or damage caused to any Customer, or any other third party, arising from any virus or other impairing computer program contained in any CV submitted by any Applicant.

      4.7 Progressive Media Publishing Ltd does not accept liability for:

      4.7.1 Any loss of copy, artwork, photographs, data or other materials that the Customer supplies to Progressive Media Publishing Ltd and the Customer shall be responsible for retaining in its possession sufficient quality and quantity of such materials for whatsoever purposes it may require

      4.7.2 Any mistakes or errors whatsoever that arise during the course of publication of any Advertisement or any loss of information or data or any damage thereto in each case as a result of circumstances beyond its reasonable control or which arise as a result of the acts or omissions of the Customer.

    4. Job Postings
    5. If the Services include Job Postings the provisions of clause 5 shall apply as set out below:

      1. All Job Postings are to be entered online by the Customer.
      2. Job Postings will remain live on the Website and available for searching via the internet for the number of weeks requested by the Customer as defined on the Purchase Order.
      3. Progressive Media Publishing Ltd makes no guarantees as to the position of Job Postings resulting from Candidate searches.
      4. Any Job Postings placed on the Website may be expired and removed by the Customer. The Customer will be charged for the full number of weeks for which the Job Postings were originally placed.
      5. Progressive Media Publishing Ltd will endeavour to ensure that all Job Postings submitted to the Website by the client are live within 4 hours
      6. The number of Job Posts a Customer can make will be determined by the Purchase Order. Should a Customer use more than their quota as outlined on the Purchase Order, Progressive Media Publishing Ltd reserves the right to charge for this additional use.
      7. Progressive Media Publishing Ltd may provide you with some free of charge services, such as editing, indexing, listings or any other material or additional media, which are over and above the Advertisement. If you do not provide the necessary text or information for any free of charge inclusions or media, then this will not affect your obligation to pay for the advertisement in full.
      8. Progressive Media Publishing Ltd retains full editorial approval over the Job Postings and any other Advertisement and positioning of this advertisement will be at our sole discretion.
      9. Job Postings can only be monitored by the Customer within the first day of submission to the Website and thereafter cannot be modified by the Customer.
      10. Job Postings and other Advertisements, unless expressly agreed by Progressive Media Publishing Ltd may not link to a Customer’s corporate website.
      11. Job Postings may not contain the details of more than one single vacancy.
      12. Featured Job Postings will be ranked higher in the Candidate’s search.
      13. Where the Customer chooses to use Vacancy Posting Software to submit Job Postings to the Website, the Customer accepts that any malfunction of, or change to, the Vacancy Posting Software or its incompatibility with Progressive Media Publishing Ltd’s systems causing incorrect, missing or multiple submissions to the Website is entirely the responsibility of the Customer and the Customer agrees that any quota of Services used and fees incurred will be payable in full.
    6. Premium Job Postings
    7. If the Services include Premium Job Postings the provisions of clause 6 shall apply as set out below:

      1. All Premium Job Postings are to be sent to Progressive Media Publishing Ltd in a format specified by Progressive Media Publishing Ltd for uploading.
      2. Premium Job Postings will remain live on the Website and available for searching via the internet for the number of weeks requested by the Customer as defined on the Purchase Order.
      3. Progressive Media Publishing Ltd makes no guarantees as to the position of Premium Job Postings resulting from Candidate searches excepting that Premium Job Postings will appear above Job Postings in Candidate searches.
      4. Any Premium Job Postings placed on the Website may be expired and removed by the Customer. The Customer will be charged for the full number of weeks for which the Job Postings were originally placed.
      5. Progressive Media Publishing Ltd will endeavour to ensure that all Premium Job Postings submitted to Progressive Media Publishing Ltd by the Customer are live within 2 working days.
      6. The number of Premium Job Posts a Customer can make will be determined by the Purchase Order. Should a Customer use more than their quota as outlined on the Purchase Order, Progressive Media Publishing Ltd reserves the right to charge for this additional use.
      7. Progressive Media Publishing Ltd may provide you with some free of charge services, such as editing, indexing, listings or any other material or additional media, which are over and above the Advertisement. If you do not provide the necessary text or information for any free of charge inclusions or media, then this will not affect your obligation to pay for the advertisement in full.
      8. Progressive Media Publishing Ltd retains full editorial approval over the Premium Job Postings and any other Advertisement and positioning of this advertisement will be at our sole discretion.
      9. Premium Job Postings can only be monitored by the Customer within the first day of submission to the Website by Progressive Media Publishing Ltd and thereafter cannot be modified by the Customer.
      10. Premium Job Postings and other Advertisements, unless expressly agreed by Progressive Media Publishing Ltd may not link to a Customer’s corporate website.
      11. Premium Job Postings may not contain the details of more than one single vacancy.
      12. Where the Customer chooses to use Vacancy Posting Software to submit Job Postings to the Website, the Customer accepts that any malfunction of, or change to, the Vacancy Posting Software or its incompatibility with Progressive Media Publishing Ltd’s systems causing incorrect, missing or multiple submissions to the Website is entirely the responsibility of the Customer and the Customer agrees that any quota of Services used and fees incurred will be payable in full.

    8. Corporate Profiles and A-Z listings
    9. If the Service includes Corporate Profiles or a-z listings the provisions of clause 7 shall apply as set out below.

      1. Corporate Profiles or A-Z listings shall remain live on the website for the period of time specified on the Purchase Order.
      2. A Corporate Profile or A-Z listing shall not contain information relating to particular job vacancies.
      3. Corporate Profiles or A-Z listings may contain one link to the Customer’s website.
      4. Corporate Profiles or A-Z listings will remain live on the website in multiples of calendar Months as requested by the Customer and as specified on the Purchase Order.
      5. Corporate Profiles may contain up to 600 words.
      6. A-Z listings may contain up to 50 words.
      7. The Customer is responsible for providing Progressive Media Publishing Ltd with all text five working days in advance of the Publication Date as specified on your Purchase Order. In supplying Progressive Media Publishing Ltd with the text for Corporate Profiles or A-Z listings, Progressive Media Publishing Ltd will post the information online and assume the text has been proofed by the Customer. If the materials provided by the Customer are in a different form to that specified then the Customer will be responsible for any reasonable extra costs that may arise in preparing the material.
      8. Progressive Media Publishing Ltd may provide you with some free of charge services, such as editing, indexing, listings or any other material or additional media, which are over and above the Advertisement. If you do not provide the necessary text or information for any free of charge inclusions or media, then this will not affect your obligation to pay for the advertisement in full.
      9. Progressive Media Publishing Ltd retains full editorial approval over the Corporate Profile, A-Z listing or any other Advertisement and positioning of this advertisement will be at our sole discretion.
      10. We reserve the right to withdraw / reject / amend the material supplied by you for the advertisement or any free of charge inclusions which will not affect your obligation to pay for the advertisement in full.
    10. Logo Buttons
    11. If the service includes Logo Buttons the provisions of clause 8 shall apply as set out below:

      1. Logo buttons shall not exceed the following dimensions: 120 x 60 pixels.
      2. Logo buttons shall be static.
      3. The duration and position of the Logo button shall be outlined on the Purchase Order
      4. Progressive Media Publishing Ltd retains full editorial approval over the Corporate Profile, A-Z listing or any other Advertisement and positioning of this advertisement will be at our sole discretion.
      5. We reserve the right to withdraw / reject / amend the material supplied by you for the advertisement or any free of charge inclusions which will not affect your obligation to pay for the advertisement in full.
    12. Job of the Week
    13. If the service includes Job of the Week the provisions of clause 9 shall apply as set out below:

      1. Job of the week adverts may link to a corporate website or a vacancy Advertisement
      2. Job of the Week Advertisements will be static.
      3. Job of the Week Advertisements are live on site in multiples of weekly periods, as requested by the Customer.
      4. The duration of the Job of the Week Advertisement shall be outlined on the Purchase Order
      5. Progressive Media Publishing Ltd retains full editorial approval over the Job of the Week Advertisement or any other Advertisement and positioning of this advertisement will be at our sole discretion.
      6. We reserve the right to withdraw / reject / amend the material supplied by you for the Job of the Week Advertisement or any free of charge inclusions which will not affect your obligation to pay for the advertisement in full.
    14. Featured Jobs
    15. If the service includes Featured Jobs the provisions of clause 10 shall apply as set out below:

      1. Featured Job Advertisements may link to a corporate website or a vacancy Advertisement
      2. Featured Job Advertisements will be static.
      3. Featured Job Advertisements are live on site in multiples of weekly periods, as requested by the Customer.
      4. The duration of the Featured Job Advertisement shall be outlined on the Purchase Order
      5. Progressive Media Publishing Ltd retains full editorial approval over the Featured Job Advertisement or any other Advertisement and positioning of this advertisement will be at our sole discretion.
      6. We reserve the right to withdraw / reject / amend the material supplied by you for the Featured Job Advertisement or any free of charge inclusions which will not affect your obligation to pay for the advertisement in full.
    16. Customer Obligations
      1. The Customer hereby undertakes and warrants to Progressive Media Publishing Ltd:
        1. To use all reasonable precautions against access of the website by any unauthorised persons, including but not limited to, the use of user names and passwords.
        2. To comply with the provisions of the Data Protection Act 1998 or relevant legislation with regard to Applicant information received by it and in particular to keep such information confidential.
        3. Each Advertisement is legal, decent, honest and truthful and complies with all applicable laws, rules, regulations and codes relating to advertising as may be appropriate.
        4. Customers conform to those terms stated in the Warranties section of this agreement.
      2. The Customer is responsible for ensuring that the content of any Advertisement and the use of the Services is not discriminatory, obscene, defamatory, or in any way illegal or in breach of any legislation. The Customer also agrees to comply with all relevant industry Codes and Practise.
      3. The Customer shall indemnify Progressive Media Publishing Ltd against all claims made by third parties in respect of the misuse of the data supplied to the Customer.
      4. The Customer shall obtain from the Applicant, as much information about the Applicant’s qualifications and experience, as is necessary for determining whether the Applicant is suitable for employment, and shall ascertain that the Applicant has such qualifications as are required by law.
      5. The Customer shall ensure that the Applicant is fully aware of any conditions imposed by law, which must be satisfied by the Applicant and that any employment resulting therefrom shall be legal.
      6. The Customer agrees not to employ, or make arrangements to employ a young person who is attending or has ceased to attend school, unless the Customer has exhausted every reasonable opportunity to provide vocational advice.
      7. The Customer shall ensure that the Applicant, before embarking on employment receives a written statement in a language the Applicant will understand giving full details of their employment.
      8. The Customer agrees to keep a written record of all job applications, for a period of not less than one year from the date of employment or, where no employment results, from the date the job application is rejected.
      9. The Customer shall;
        1. Use all CVs supplied for the sole purpose of endeavouring to provide or locate suitable employment on behalf of Candidates.
        2. Keep confidential the CVs and all other information supplied by Progressive Media Publishing Ltd or Candidates to the Customer or its employees or agents and shall only use such information for such agreed purpose if endeavouring to seek or provide employment opportunities for Candidates with their express consent in respect of their CVs.
        3. Not submit, copy, supply, re-sell, distribute or make available in any way any CVs or other information received from industryappointments.com to any person provided that where the Customer is a recruitment agency it may make CVs available to its genuine End Clients who intend to recruit such Candidates for their own employment.
      10. The Customer:
        1. Authorises Progressive Media Publishing Ltd to accept instructions in relation to the Services (without having to refer to the Customer) from any Recruiter and any person using such passwords.
      11. Where the Customer is a Recruitment Agency they shall comply in all respects with the Employment Agencies Act 1973 (and all regulations made thereunder) and all statutes, rules, regulations, codes of practice and legal requirements to which the Customer is ordinarily subject in respect of its receipt and processing of CVs and related matters.
      12. It is the responsibility of the Customer to inform Progressive Media Publishing Ltd of any changes of contact details.

    17. Progressive Media Publishing Ltd Obligations
      1. Progressive Media Publishing Ltd will use its reasonable endeavours to enable Applicants the facility of viewing the Customers’ Advertisements on the website and to provide the Services to the Customer. However the Customer accepts that Progressive Media Publishing Ltd cannot guarantee the number of occasions on which an individual Advertisement appears on the website and that no obligations are imposed on Progressive Media Publishing Ltd in this regard.
      2. If (for reasons beyond its control) Progressive Media Publishing Ltd is unable to keep the Website live or updated for a period of 15 working days or more, the Customer shall be entitled to a pro rata rebate of monies paid to Progressive Media Publishing Ltd.
      3. In the event of Services being unavailable for any consecutive period of 24 hours (with the exception of de-activated accounts due to late payment), Progressive Media Publishing Ltd shall extend the term of this agreement by the period of such non-availability, without any further payment by the Customer.
    18. Term and Termination
    19. 13.1 This agreement may be terminated by Progressive Media Publishing Ltd if:

        1. After providing written notice to the Customer of breaches in section 11 entitled Customer Obligations are not rectified within 10 working days.
        2. If the Customer fails to pay Progressive Media Publishing Ltd on the due date any sums that may be due under the terms of this agreement.
        3. If the Customer makes any material misrepresentation in order to become a registered user of this website.
        4. If the Customer is using the Website for any improper use or with the intention to damage the reputation of either the Website or the Services provided by Progressive Media Publishing Ltd.
      1. Either party may terminate this agreement immediately by notice to the other: If any resolution or petition to wind up the other’s business (other than for the purpose of amalgamation or reconstruction) shall be passed or presented or if a receiver or administrative receiver of the other’s undertaking, property or assets shall be appointed but the Customer acknowledges that except in such circumstances, it has no right to terminate this agreement
    20. Warranty and Indemnity
    21. The Customer warrants to represent to Progressive Media Publishing Ltd that: (i) the Customer has all necessary rights to grant the rights and licences set out in the contract to Progressive Media Publishing Ltd; (ii) neither the copy material provided by the Customer nor any material which may be linked to through your Advertisement will contain anything that is defamatory, obscene, false or misleading or which otherwise violates any intellectual property rights or rights of any person; (iii) use of the copy material provided by the Customer will not violate any applicable law or regulation. The Customer agrees to indemnify Progressive Media Publishing Ltd against all damages, costs or fees arising from a breach of the above warranties including claim or action by a third party.

    22. General
    23. The Customer may not resell, assign or transfer any of their rights under this contract without Progressive Media Publishing Ltd’s written consent. Any attempt to resell, assign or transfer rights without our consent will entitle us to cancel the contract without liability to you. A person who is not a party to this contract has no right under the Contracts (Rights and Third Parties) Act 1999 to rely upon or enforce any terms of this agreement.

    24. Miscellaneous
      1. The signing of the Purchase Order for provision of Services amounts to an acceptance of these Terms to the exclusion of any other terms and conditions. No variation shall be binding unless agreed in writing.
      2. If any provision of these Terms is held to be void or unenforceable in whole or in part, these Terms shall continue to be valid as to the other provisions and the remainder of the affected provision. No waiver by Progressive Media Publishing Ltd shall be effective except in relation to the matter in respect it was specifically given.
      3. Nothing in these Terms is intended to confer on any person any right to enforce any provision of these Terms, which that person would not have had but for the Contracts (Rights of Third Parties) Act 1999. Insofar as the Customer is a consumer (as that term is defined in the Consumer Protection Regulations (2000)), the Customer agrees that the provision of Services under these Terms may, by agreement between the Customer and Progressive Media Publishing Ltd, take place before the end of any applicable cancellation period, in which case the right to cancel such provision of Services shall not apply.
    25. Jurisdiction
    26. This agreement is governed by and will be construed in accordance with English law and each party irrevocably agrees that the courts of England will have the non-exclusive jurisdiction to deal with any disputes arising out of or in connection with this agreement. Changes to this contract can only be made in writing. Printed terms and conditions in any additional documents issued by the Customer or their agent will not be recognised as binding.
